APPENDIX III

(SECRET)

POINTS OF AGREEMENT REACHED IN DISCUSSION BETWEEN HIS EXCELLENCY THE GOVERNOR OF ASSAM AND THE MANIPUR STATE DARBAR

1. It was agreed that the State should forthwith declare that it joins the Constituent Assembly (Hindustan) and that Mr. Guha should be accepted forthwith as the representative of the State as it is not practicable to have a separate representative for the State. Mr. Guha should be assisted by advisors appointed by His Highness in Council representing both the Hill and Valley areas.

2. I was agreed that there ought to be the closest relationship on a reciprocal basis between Manipur and Assam and the Indian Union.

3. It was agreed that assistance both in external defence and in internal security by the Union Government would be nencessary and that the Assam Rifles should be retained in Manipur State.

4. It was agreed in principle that reciprocal arrangements based on similar arrangements with other Indian States should be entered into with regard to the Mao-Tamu Road.

5. It was agreed that the Union Government should retain the present Post and Telegraph facilities, and also continue the supply of controlled commodities, and that no discriminatory measures should be taken in reagrd to the export and import of goods. It was agreed that the present arrangements regarding Extradition, Currency, and exemption from Provincial taxation on goods passing through the Province of Assam in transit to Manipur should continue.

6. It was agreed that the Union Government should appoint an officer to be stationed in Manipur to represent that Government in these matters.

7. It was agreed that there should be the minimum of inteiference in the internal affairs of the State.

8. It was agreed that the Union Government should retain their Treasury here as at present, and continue the existing facilities.

9. It was agreed that the retrocession of the British Reserve should be expedited, but that until alternative arrangements were made the Cantonment area, the Residency and Political Agents's Office Compounds and the area known as Babupara, should remain under the control of the Union Government

10. It was agreed that it is desirable that an "interim" Council be formed without delay, and that the members should be appointed unda the new Administration Rules and should comprise the present P.M.S.D. as Chief Minister, the two senior Manipuri Members of the existing Darbar, the present Muslim Member, two members of the public to be elected by the same system as was used for the elections to the Constitution-Making Committee, and one Hill representative to be nominated under the new rules.

11. It was agreed that the new constitution should be inaugurated within a period of one year.

12. That the question of the future payment of the Kabaw valley compensation will be taken up with the Union.

APPENDIX VIII

AGREEMENT BETWEEN HIS HIGHNESS THE MAHARAJA OF MANIPUR AND HIS EXCELLENCY THE GOVERNOR OF ASSAM


Without prejudice to whatever agreement or Treaty may in due course be arrived at between the Manipur State and the Union Government and till such time as an agreement or treaty is reached with Union Government after the New State Constitution is introduced His Highness the Maharaja in Council agrees :-

(a) That the Administration Rules introduced on July 1 st 1947 and allied measures including the appointment Board Rules, the State Courts Act and the Account Rules shall continue in force after August 15th 1947 or such date as Paramountcy may lapse and shall not be the subject of amendment except by His Highness in Council, who shall inform His Excellency the Governor of such amendment.

(b) That the controls provided in the Confidential Instruction to the Administration Rules shall continue saving that clause (a) shall lapse on the introduction of the Hill Regulation and that in clause (/) it shall be provided that the State Budget shall be submitted to His Excellency for his information and advice. Further that wherever the term "Agent to the Crown Representative" and "Political Agent" is used in the Instruction the terms "agent to the Government of the Indian Union" and Union Agent shall be substituted.

In addition His Highness in Council shall accept any advice tendered by His Excellency the Governor of Assam as Agent to the Government of the Indian Union in any matter concerning the State, it being understood that there shall be the minimum of interference in the internal affairs of the State.

(c) That the introduction of Constitutional Government shall be expedited and that His Highness in Council shall submit proposals in this regard as early as possible to His Excellency the Agent to the Union Government for his advice.

(d) That His Highness in Council shall accept an officer appointed by the Union Government and residing in the State to act as agent to His Excellency in the exercise of functions vested in His Excellency by this agreement; further whatever facilities are required by this officer and by whatever troops may be stationed in the State shall by mutual agreement be provided.

(e) The Officer of the Union Government stationed in the State may call for any records connected with a matter concerning a member of the Hill Tribes at his discretion and may issue such advice as seems necessary. Further that facilities shall be given for the Union Officer to tour in the State and that no orders shall be issued under Section 77 or 78 of the Hill Regulation without the prior advice of the Union Agent. Should these sections be deleted in the course of discussion this last provision will not arise.

(f) Further that in the application of the power vested in him under this Section the Union Agent shall avoid inteference in the day to day administration of the Hills.

(g) That the Hill Regulation shall be introduced simultaneously with the State Courts Act and that this shall be done before August 15th 1947.
